Terms of Use

The short version. These terms cover the underscore.music website. They are not the licence for the Underscore application – that is Apple's Licensed Application End User License Agreement, which you accept from Apple when you download the app. See section 2.

These terms govern your use of underscore.music and its subdomains (the “site”), operated by The Undernet LLC, an Illinois limited liability company (“we”, “us”). By using the site you agree to them. If you do not agree, please do not use the site.

1. This website

The site is provided for information about the Underscore application. We may change, move, or withdraw any part of it at any time, and we do not promise that it will always be available or free of errors. Nothing on the site is an offer, a warranty, or professional advice of any kind.

Where the site describes what Underscore does, it describes the version we have released. Statements about future features are intentions, not commitments, and do not form part of any agreement.

2. The Underscore application

These terms do not license the app. Underscore is distributed through the Mac App Store, and your licence to use it is granted by Apple's Licensed Application End User License Agreement (the “Standard EULA”), which you accept when you acquire the app. We have not substituted a custom agreement in its place. Where anything on this page appears to conflict with the Standard EULA in respect of the application, the Standard EULA governs.

Purchases, refunds and support obligations. Apple is the seller. Pricing, billing, and refunds are handled by Apple under its own terms; we cannot issue a refund for an App Store purchase, and you should request one from Apple directly. We are, however, responsible for the app itself, and support questions are welcome at info@theunder.net.

What you make with it is yours. We claim no rights of any kind in the audio, patterns, projects, or exported files you produce with Underscore. There are no royalties, no attribution requirement, and no restriction on commercial release. This applies equally to material made using the factory kits included with the app, which you may use in your own work without further permission.

3. Intellectual property

The site, the Underscore application, the name “Underscore”, the Underscore icon and wordmark, and the design and text of this site are owned by The Undernet LLC and are protected by copyright and trade mark law. You may quote or link to the site with attribution; you may not copy the site's design or code wholesale, or use our name or marks in a way that suggests we endorse or are associated with something we are not.

Typefaces, code libraries and other third-party components used in the site and the application remain the property of their respective owners and are used under licence. Nothing here grants you any right to them.

4. Acceptable use

You agree not to:

  • use the site in a way that breaks any applicable law;
  • attempt to gain unauthorised access to the site or the systems it runs on;
  • attack the site, including by denial-of-service, or knowingly introduce malicious code;
  • scrape or harvest the site in a manner that places an unreasonable load on it.

5. Third-party links

The site links to third parties, including Apple and our documentation host. We do not control those sites, we are not responsible for their content, and a link is not an endorsement. Their terms and privacy policies apply when you are on them.

6. Privacy

Our handling of personal information is described in the Privacy Policy, which forms part of these terms.

7. No warranty

The site is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. Warranties relating to the Underscore application are addressed by the Standard EULA referred to in section 2, not by this section.

8. Limitation of liability

To the fullest extent permitted by law, The Undernet LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or audio work, arising out of your use of the site. Our total liability arising out of or relating to the site will not exceed one hundred United States dollars (US$100).

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, these terms do not affect your statutory rights.

9. Changes

We may revise these terms from time to time. The date at the top of this page shows when they were last changed, and the version in force is the one published here when you use the site.

10. Governing law

These terms are governed by the laws of the State of Illinois, United States, without regard to its conflict of law rules, and the state and federal courts located in Cook County, Illinois will have exclusive jurisdiction over any dispute arising from them. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory law of your own country of residence.
